Here is my situation that I am going thru right now
I am in the process of taking care of my Late Aunt's estate. I always knew I was one of 2 Executors of her estate but figured we had years before we had to start worrying about it.. she told me March 2004 and March 2,2008 my favourite Aunt Luanne passed unexpectedly.
Since she made her will she remarried which means the will is invalid..although they had a prenuptuial ( more to keep my grandfather happy, thinking he would be gone before Luanne)
So now my mom myself and my uncle have applied to the courts to be made Trustees. Which means we have to give the courts a cheque sort of as a bond to ensure we will pay off all debts and be responsible for everything. The bond could be 200,000.00 so we have to apply to the bank FOR A LOAN.. because we do not have money available...
Because there is a prenup everything goes to the next of kin which means my grandparents get everything..unless there is a named benifciarry. which in some cases my dd is named.. not her husband cause she never changed anything after they married..soooooooooo he gets nothing..
See where I am heading with this.. Trust me,...I may not know all of u but please do 1 thing for me,..talk to hubby/wife and get a will prepared. Do not leave a heavy burdon on your family like what I am dealing with.. bad enough my best friend, fave aunt and boss died but now I cant grieve for her cause I am too busy with all of what is going on.

Well things have settled for abit now.. we are awaiting for the Letter of Administration for the estate to come thru so we can pay off everything..Right now we are hoping that they do this without asking for a Bond. a percentage of her estate up front..
But we still have not done anything for ourselves for a will..

DO u guys use a lawyer or who?
We used Will Expert program. It is a myth that you need a lawyer to do a simple will.
